Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Body Battery iOS application (the “App”) and our public website, including the Support & feedback pages (together, the “Services”), operated by Body Battery (“we”, “us”, or “our”).

By downloading, installing, or using the App, or by accessing our website, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Licence to use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple device that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

This licence does not allow you to:

  • Copy, modify, distribute, or create derivative works based on the App.
  • Reverse-engineer, decompile, or disassemble any part of the App.
  • Rent, lease, lend, sell, or sublicense the App to others.
  • Remove, alter, or obscure any copyright or proprietary notices in the App.

2. Acceptable use

Body Battery is designed for personal wellness and educational purposes. You agree to use the Services only for their intended purpose and in compliance with all applicable laws. In particular, you agree not to:

  • Use the Services for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorised access to the App, its servers, or any connected systems.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Upload or transmit viruses, malware, or any other harmful code through the Services.
  • Use the App’s output as a substitute for professional medical advice, diagnosis, or treatment.

3. Health and wellness disclaimer

Body Battery is a wellness and educational tool only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The Energy Level score, body status tiles, trend charts, and any other information provided by the App are based on general wellness algorithms and your Apple Health data. They are meant to give you a broad sense of how your body is doing day to day, not to replace the advice of a qualified healthcare professional.

Always consult a doctor or other qualified health provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or saw in Body Battery.

4. Intellectual property

All content in the App and on our website, including but not limited to text, graphics, logos, icons, images, and software, is the property of Body Battery or its licensors and is protected by copyright, trademark, and other intellectual property laws.

The Body Battery name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use them without our prior written permission.

5. Subscriptions and payments

Some features of the App require a paid subscription. Subscriptions are billed through the Apple App Store and managed via your Apple ID account.

  • Billing. Subscription fees are charged at the beginning of each billing period (monthly or annually, depending on the plan you choose).
  • Auto-renewal. Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period.
  • Cancellation. You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; you will continue to have access to paid features until then.
  • Refunds. Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.

6. Disclaimers and warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the App will be accurate or reliable.
  • Any defects in the App will be corrected.

You acknowledge that the Energy Level score and other metrics are estimates based on available data and algorithms and may not reflect your actual health status.

7. Limitation of liability

To the maximum extent permitted by applicable law, Body Battery and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the Services.

In no event shall our total liability to you for all claims arising from or related to the Services exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Body Battery and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

9. Termination

We may suspend or terminate your access to the Services at any time, without prior notice, if we reasonably believe you have violated these Terms or if required by law.

You may stop using the Services at any time by deleting the App from your device. If you have an active subscription, remember to cancel it through your Apple ID account settings to avoid further charges.

Upon termination, the licence granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and indemnification) will continue to apply.

10. Third-party services

The App may interact with third-party services, including Apple Health and the Apple App Store. Your use of those services is governed by their own terms and conditions. We are not responsible for the content, policies, or practices of any third-party services.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your information. By using the Services, you agree to the collection and use of information as described in the Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. We encourage you to review these Terms periodically.

Your continued use of the Services after any changes indicates your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Services.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Body Battery operates, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Services shall be resolved in the competent courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
